(also referred to here as “HAVOBODY”, “we”, “our”, or “us”) collects, uses, and shares information about you (“you”, “your”, or “user”) when you use our website at www.havobody.com and any other platforms we may provide including mobile applications, related social media websites (such as Facebook, Instagram, Pinterest), or through your interactions with us (via our website, applications, products, services and social media pages; referred to as “Services). This privacy also describes your and our legal rights on “Personal Information” which could be used to identify you.

J.S. Haverly Ltd. (also referred to as “HAVOBODY”, “we”, “our”, or “us”) is committed to protecting your personal privacy. This privacy policy describes how www.havobody.com and any other platforms we may provide including mobile applications, related social media websites (such as but not limited to Facebook, Instagram, Pinterest, Youtube, etc.) collects, uses and discloses your Personal Information when you visit or make a purchase from the site.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service. When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

 

1. Collecting Personal Information

When you visit our site, we collect certain information about your device, your interaction with the site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual  as “Personal Information”. This information may be shared with our processor Shopify for business purposes.

When you browse our store, we automatically receive device information when you access our site using cookies (such as your version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the site). This provides us with information to help us learn about your browser and operating system in order to load our site accurately for you and to perform analytics on site usage for optimisation.

When you provide us with Personal Information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase (including name, billing address, shipping address, payment information such as credit card numbers, email address and phone number), we infer that you consent to our collecting it and using it for that specific reason only. The purpose of collection is to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

4. Using Personal Information

We use your Personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services and offers. 

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your Personal Information under the following lawful bases:

  • The performance of the contract between you and the site;
  • Compliance with our legal obligations;

We do not engage in fully automated decision-making that has legal or otherwise significant effect using customer data. 

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP address associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

 

7. Your Rights

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated or erased. Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States.
